Is it legal to take my driver's test with an expired permit? Many drivers are confused by the laws surrounding driving licenses and permits. As a responsible driver you should also be aware of the risks of driving without a valid permit or license.

As a new driver, the only time you should have your license is when you pass your road test. However, if you've already had your license for a number of years then there may be no need to renew your permit or license. It is illegal to drive without either a permit or license, but there are some circumstances in which it may be legal to take your driver's test with an expired permit.

You may need to do this if you've had the permit before and had it confiscated. If you've already had your permit revoked, it will stop the DMV from issuing you a replacement permit. If you try to renew your permit you may be turned down, or if you have a valid interstate permit you may still be rejected. If you do have a valid interstate permit and it's been long expired then you will need to have it renewed.

If you've just purchased a new car, you may find that your insurance company won't cover your driving until you're good enough to drive a car on the road. As a responsible driver, you may be able to take your driver's test with an expired permit and only pay for the car.

It is also legal to drive with a temporary permit and it doesn't mean you are breaking the law. If you've just purchased a new car or rented a car recently and don't have insurance yet, you may be able to drive without having your permit issued. You may also be able to drive with a temporary permit until you can find insurance.

If you are driving with a temporary permit to take your driver's test and the DMV doesn't issue you a permit then you may be able to drive yourself and pay the DMV the difference between the cost of the car and the insurance. You may also be able to use this to help cover the cost of your ride.

If you are going to use your permit to drive without insurance, you will need to take a further driver's course to learn about insurance and driving. After passing the course you will be allowed to drive without insurance, but you may need to get insurance or carry it yourself.

If you are taking your driver's test on a road that has additional hazards than what is required by the exam, you may be able to drive on this road without a permit. This doesn't include cross roads where only one lane of traffic can go and another lane for the pedestrians. You can also drive through a school zone if you are going to an area of the school you will be doing a separate exam.

If you are taking your driver's test at night, you may be able to take your exam in a hotel, on campus or on study courses. You may even be able to drive to the next state and just study there. Most people take their driver's exams in their home state and then take a break for the week, then go back to take the exam in the new state.

If you have a good safety record as a new driver, it doesn't make sense to get a permit. On the other hand, if you have had accidents or been involved in accidents you may be able to get a permit. You can only apply if you have a clean record and you're not currently on probation.

If you're going to take your driver's test in a school or workplace which is a designated driving school then you may be able to get the same type of permit as the students there. If you haven't passed your road test, you'll be given a permit instead of a license. You may need to have your permit renewed before you can take your final exam.

If you're unsure whether you can take your driver's test with an expired permit, then talk to an attorney who specialises in motor law. or check the DMV website for advice.
